Washington State: Enacted sweeping "middle housing" legislation requiring larger municipalities to allow duplexes, triplexes, or fourplexes on any lot traditionally zoned for single-family homes.
Under Washington State’s House Bill 1337 (codified under RCW 36.70A.680), cities and counties fully planning under the Growth Management Act (GMA) must allow up to two ADUs (Attached or Detached) on any single-family residential lot within an Urban Growth Area (UGA).
Key State Regulations
State law sets baseline standards that local municipalities must follow. These prevent cities from heavily restricting the creation of Accessory Dwelling Units (ADUs) or Detached Accessory Dwelling Units (DADUs):
• Unit Count: Municipalities must allow at least two ADUs per lot (either attached, detached, or a mix) in addition to the principal home.
• Size: Local governments cannot force ADUs to be smaller than 1,000 square feet.
• Owner-Occupancy: State law prohibits jurisdictions from requiring the property owner to live on-site in either the principal unit or the ADUs (unless the property is used as a short-term rental).
• Parking: Parking requirements are strictly limited. No on-site parking can be required for ADUs located within a 0.5-mile radius of a major transit stop
